A city firefighter involved in a motorcycle accident in June out of service has been denied health insurance for their injuries health insurance because the city was forced to wear a helmet.
Lieutenant James Baker waited to see if the board accept a negotiated settlement of this night pay a reduced amount.
The Sebring City Council will meet at 6:30 pm today at 368 S. Commerce Ave. vote on this issue and many others.
Baker was injured in a motorcycle accident in U.S. 27, where the medical demand rose to about $ 86,000. He was taken to a trauma center at Tampa General Hospital.
"I was a little less than two months," said Baker. "I returned to full rate to 01 August 2009."
Baker's insurance claim was initially denied due to a clause added to the policy of the City of Medicare in 2005 on the "dangerous activity" are excluded coverage for motorcycle accidents without helmets.
Baker said he was wounded regardless of helmet use, and therefore the application should be granted. Suffered wounds in the abdomen and especially head injuries, "he said Monday.
In 1998, when he was hired, Baker said he had received a copy of your policy insurance, and where the exclusion clause was there. He had no memory of the notification that he was loved, "he added.
If there known of the exclusion, would be wearing a helmet, he said.
At a meeting of the City Health Insurance, said City Clerk Kathy Haley did not know whether the announcement added exclusions were issued to city employees, the minutes of the meeting show.
Mayor George Hensley said a committee or an employee may consider the various activities as "dangerous."
Noethlichs Municipal Administrator Scott agreed, but asked how to define "dangerous."
Representatives from the City Manager of Medicare, anchoring benefits, negotiated a $ 46.750, they have to pay.
At a meeting special meeting held on February 25 The Committee recommended that the Council accepts the delivery of benefits negotiated anchor, provided that Baker pay the maximum of the other outside his own pocket for the year of $ 734.74 and a cost of $ 745 to negotiate the claims.
The tentative agreement was also concluded that the basis of the recommendation was that Baker has not received head injuries and he was injured, but with a helmet at the time of the accident.
However, it the Council to approve the deal.
Hensley said Monday that representatives of the anchor of the benefits council said that this exclusion is not normally in insurance policies, and Hensley believed the city would likely be closer.
Baker has since stopped motorcycle, citing his love for his wife and five children.
He said his wife told him when he was at Tampa General Hospital, still knew how he liked the bike and asked to leave.
"It'sa hobby," said Baker. "I was willing to give up, do not put my family through it again."
